Complaint:  The company is collecting a dept for student loans I call to make arrange with them and they declined my offer, I have ask the company 3 times not to contact me on my job. They refuse to stop calling me on my job I work for a very large company. They don't even know if they have the right person or another person they don't ask you to verify any information that indicates that it's you. Casie Thomas and Mark Martinez just state to me that they are going to garnish my wages. When can i pay i call them to make reasonable arrange they decline. I am being treating and i could lose my job from them calling every day.

Credit Clean Opinion:  In our opinion you should file a complaint with the Federal Trade Commission, The Attorney General In The State Of California and Texas, The Better Business Bureau in California and Illegal Practices of Law.  You should type up a letter to the collection agency and include in the letter that you want them to CEASE & DESIST calling your place of business.  Send them a list of the places you are filing complaints.  Make sure you send this letter certified mail with a return receipt.  Anything you do with a collection agency should be written on paper and sent by certified mail.

Complaint:  I OWED A DOCTOR 1787.50 FOR SERVICES RENDERED. I WENT TO COURT IN NOVEMBER OF 2005 AND PROMISED TO MAKE MONTHLY PAYMENTS. I SINCE THEN HAVE MADE MY MONTHLY PAYMENTS, AND TO MY SURPRISE THIS AGENCY HAS PUT A GARNISHMENT ON MY WAGES. I CALLED AND SPOKE TO JOSH AT PHILLIP ROTHE OFFICE AND HE TOLD ME MY ARRANGEMENTS WERE NOT GOOD ENOUGH. HE THEN AFTER BEING VERBALLY ABUSIVE HE HUNG UP ON ME. I AM VERY UPSET. FINANCIALLY I AM VERY STRAPPED. DIVORCED, TWO CHILDREN AND A DISABLED MOTHER, I HAVE A LOT ON MY PLATE. I AM WILLING TO CONTINUE TO MAKE MY PAYMENTS, BUT DON'T FEEL THEY HAD A RIGHT TO GARNISH MY WAGES. I DON'T KNOW WHAT RECOURSE I HAVE.

Complaint:  I was making payments of $100.00 a month my husband got sick and was out of work I explained I couldn't make a payment for that amount but was willing to pay a smaller amount .She said no she wouldn't accept any less than $100.00 .She told me she would turn it back over to original creditor and they would sue and garnish my wages. I got a letter 2-10-06 stating that I now have thirty days to pay $3,000.00 or they are taking me to court.

Credit Clean Opinion:  In your case the credit bureau is acting as a collection agency so they do have to follow the rules and regulations of a collection agency and have no other powers over and above that, with that said: Any letter you get from a collection agency is nothing but a threat ... yes the threat could be followed through with but there is nothing you can do about it until or if they do something.  Nine times out of ten they won't follow through.  If they do follow through all you have to do is show up at the court date or respond to the arbitration letter that they must do prior to anyone being able to get a judgment against you.  You have a chance to explain your side of the story in arbitration or if you get a court date you again have a chance for mediation or telling your side of the story.  If you can't pay something you can't pay it, the old saying is "you can't get blood out of a turnip".  You made the attempt to pay, you had other problems, they would give you a different payment option so you have done everything humanly possible to appease this collection agency.  I would respond to the letter that was last sent to you and ask for proof that the debt is yours and all information about the debt be sent to you.  This stalls any action by them for at least 30 days.  Also, if the original debt is old you should let me know how old there may be some rules there that apply.  Tell me who the original creditor is as well and how much you originally owed, how much you have paid and what the approximate date was that they account with the original creditor was closed.  One thing you shouldn't do is worry about this ... there is no such thing as debtors prison any more.

Complaint:  Male calling from 321-206-4136 called my place of employment, and when questioned about what he wanted and the fact that I have a cease and desist order out to any creditor that I may have, the male stated I was rude and hung up. When I called back to get their fax number so that I could re-fax this to them, he refused, I asked for a supervisor (Sam is what he said his name was), the supervisor stated he refuses to give me the fax number, told me that "God loves me" and hung up. How can I stop someone from calling my home or place of employment if I cannot garner any information to send it to them?

Credit Clean Opinion:  You have a phone number right?  If so, then you need to call name and address service and find out what the name of the collection agency is and what the address is.  You can do this by giving the telephone company the number that you have been called from.  Once you find out the address all you have to do is send a letter via certified mail to the company.  List all identifying information that they have used with you on the phone such as your name, account number, telephone numbers they have called etc.  If after ten days you are still getting calls from them and you have received notification that they did receive your cease and desist letter (confirmed by certified mail) then you need to file a complaint with the Federal Trade Commission, Illegal Practices of Law, the Better Business Bureau and in your state and the state this company is operating in file a complaint with the Attorney General's Office.
